In a short sale, you sell the home with your lienholders' approval when the net proceeds aren't enough to pay off what you owe. In a foreclosure, the lender takes legal action and the property is sold at auction. A short sale usually gives the homeowner more say over timing, the move and how the sale is handled. When an offer comes in, it goes to each lienholder with your hardship letter, financial documents and a settlement statement. The lienholders review the package and decide whether to accept a payoff that is less than the balance. Throughout, you stay in the home, keep showing it and choose your move-out date within the contract terms. You, or your representative, negotiate with the lender. ## How a foreclosure works in Maryland Maryland foreclosures run through the circuit court in the county where the property sits, so a Frederick County home goes through the Frederick County Circuit Court. The lender files the case, the homeowner receives notices, and the property is eventually sold at a foreclosure auction. Owner-occupants can generally request foreclosure mediation, which brings the homeowner and lender together to review alternatives.
