What Probate Real Estate Services Include

Probate is the court-supervised process of settling a person's estate after death. When the estate includes a home, someone has to care for it, decide whether to keep or sell it and, if selling, handle the sale. Our Probate Real Estate Services cover the real estate side:

  • A walk-through of the property and a conversation about the family's goals
  • A suggested price range for the estate's records and planning
  • Help coordinating the logistics of clean-out, repairs or an as-is sale
  • Listing, marketing and showings
  • Offer review and coordination with the estate attorney, title company and settlement attorney
  • Regular updates for the personal representative and, with permission, the heirs

We do not give legal or tax advice. The estate attorney guides the probate process, and a CPA can advise on tax questions, including any related to the sale.

The Personal Representative's Role

In Maryland, the person who manages an estate is called the personal representative. Other states may use the term executor or administrator. In general, the personal representative is appointed through the Register of Wills in the county where the person lived and receives letters of administration, the document that shows their authority to act for the estate. The title company will usually ask for a certified copy of these letters before settlement.

Washington DC estates are handled through the Probate Division of the DC Superior Court, and Virginia estates generally begin with the clerk of the circuit court. If the property is in a different state from where the person lived, an additional proceeding may be needed there. Your attorney will explain which applies.

Does the Sale Need Court Approval?

The answer varies. Whether a probate sale needs court approval depends on the type of estate, the terms of the will, state law and, sometimes, whether all interested persons consent. Some estates allow the personal representative to sell without a separate court order; others require one. Your estate attorney will tell you which applies and how it affects the contract timeline. When approval is needed, we build that step into the contract and keep buyers informed.

Our Probate Sale Process

1. A first conversation

We listen to the family, learn about the home and talk through timing. If the personal representative has not yet been appointed, we can still visit the home and prepare a suggested price range for planning.

2. Securing the home

Vacant homes need attention. We suggest the personal representative check with the insurance carrier about vacancy coverage, keep utilities on and arrange routine maintenance.

3. Pricing

We give you a suggested price range based on recent sales of the homes closest to the estate property in location, style, size, age and condition. A comparative market analysis is a broker opinion of value, not an appraisal. Many estates also order a formal appraisal as of the date of death, which the attorney or CPA may recommend. The personal representative sets the price, and buyers decide what to offer.

4. Belongings and preparation

Sorting a loved one's belongings is personal work. We help coordinate the logistics and timing so family members can take keepsakes before any estate sale, donation or clean-out takes place. Then we help you compare an as-is sale with making selected updates.

5. Listing and offers

We prepare the listing, photography and showing plan, then help the personal representative review every offer and its terms.

6. Settlement

We work with the title company or settlement attorney so the personal representative can sign in person, by mail or through a remote closing. Proceeds go to the estate, and the attorney advises on distribution.

When the Home Has a Mortgage or Liens

The first mortgage is a lien and usually holds first priority, and it remains on the property after the owner's death until it is paid. The personal representative should notify the mortgage servicer, and many servicers have a process for estates. With authorization, we request payoff statements from every lienholder. If the home is worth less than what is owed, the sale may be a short sale, which is a home sale where the net proceeds aren't enough to pay off the mortgage, so the lender must approve accepting less. If the home had a reverse mortgage, the servicer will have its own requirements and timelines, and the attorney can explain them.

Heirs, Families and Communication

Estates often involve several heirs, and not everyone lives nearby. With the personal representative's approval, we provide neutral, factual updates so everyone has the same information. Remote closings for out-of-state and overseas sellers are a specialty, and we have closed sales for sellers living outside the country. Questions about an heir's rights or the distribution of proceeds belong with the estate attorney.

Frequently Asked Questions

What do Probate Real Estate Services from Real Estate Search and Sale, LLC include?
Help for personal representatives selling an estate home: a suggested price range, a plan for the contents and condition, marketing, offer review and settlement timed to the probate process. The estate attorney advises on court approvals and legal requirements. Carolyn Thompson is a Seniors Real Estate Specialist (SRES).

How do you sell a house in probate in Maryland?
The personal representative, once appointed through the Register of Wills, lists and sells the home on behalf of the estate. The estate attorney confirms whether court approval is needed, and the title company asks for certified letters of administration before settlement.

Can you sell a house before probate is complete?
Often, yes, once the personal representative has been appointed and has authority to sell. Your estate attorney can confirm the timing for your estate.

How long does it take to sell a probate property?
The sale itself often follows a typical listing timeline, but court approval, title requirements and estate steps can add time. Your attorney can explain the probate schedule.

Do all heirs have to agree to sell the house?
It depends on the will, the type of estate and state law. Ask the estate attorney whether heir consent or notice is required.

Who pays the mortgage while the house is in probate?
Payments are often made from estate funds while the home is being sold. The personal representative should contact the mortgage servicer and ask the attorney how to handle ongoing expenses.

Should I sell the estate house as-is?
Many estate homes sell as-is, while others benefit from selected updates. We help you compare both options so you can decide.

Can an executor living out of state sell the house?
Yes. Remote closings for out-of-state and overseas sellers are a specialty of ours.

Can I get references?
Yes. We provide a list of client and professional references on request.
